Welcome to The Stove is On (the "Site"), the official website and content hub for the band The Stove is On ("we," "us," "our," or "the Band"). By accessing or using our Site, purchasing our digital content, merchandise ("merch"), or engaging with our community, you ("you," "your," or "User") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Site or purchase any content.
1. Acceptance of Terms; Modifications
These Terms constitute a legally binding agreement. We reserve the sole right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site after changes constitutes your acceptance of the new Terms.
2. Intellectual Property Rights
2.1 Ownership
All content on this Site, including but not limited to music, audio downloads, videos, artwork, photographs, designs, logos, text, graphics, and software, is the exclusive intellectual property of The Stove is On and its licensors. 2.2 Limited License for Purchased Digital Content
Upon your lawful purchase of digital content (e.g., audio downloads, exclusive videos), we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and access that content for your personal, non-commercial use only. This is a license, not a sale of the content itself.
You MAY: Download the content to your personal devices and enjoy it privately.
You MAY NOT: Reproduce, distribute, publicly perform, transmit, sell, rent, lease, license, modify, create derivative works from, or otherwise exploit the content for any commercial purpose. You may not upload the content to any file-sharing, streaming, or social media platform, or make it available for public download.
2.3 Merchandise
Purchasing physical merchandise grants you ownership of the physical item only. All artwork, logos, and designs on the merch remain the intellectual property of The Stove is On. You may not reproduce the designs for any commercial purpose.
3. User Accounts & Purchases
3.1 Account Responsibility
You are responsible for maintaining the confidentiality of your account and password and for all activities under your account.
3.2 Purchase Terms
All sales of digital content and merchandise are final. Due to the nature of digital goods, we do not offer refunds or exchanges for downloaded audio files, videos, or other digital content once the download link has been accessed or the content streamed.
Refund requests for defective physical merchandise must be initiated within 14 days of receipt, subject to our sole discretion and verification of defect. See our separate [Return Policy].
3.3 Pricing and Availability
We reserve the right to change prices for any content or merch at any time and to correct pricing errors. All purchases are subject to availability. We may limit or cancel quantities purchased per person or per order at our sole discretion.
4. User Conduct & Prohibited Activities
You agree not to use the Site to:
Infringe upon our intellectual property or the rights of others.
Attempt to circumvent any content protection or access controls.
Use any data mining, robots, or similar data gathering tools.
Upload viruses or malicious code, or engage in any activity that disrupts the Site's functionality.
Harass, threaten, or defame the Band, its members, or other users.
5. Termination
We may, at our sole discretion, suspend or terminate your account and access to the Site and any purchased content licenses without notice or liability if we believe you have violated these Terms. Upon termination, you must cease all use of the Site and destroy all downloaded content in your possession.
6. Disclaimers & Limitation of Liability
6.1 "As Is" Basis
The Site and all content are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind. We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.
6.2 Limitation of Liability
To the fullest extent permitted by law, The Stove is On, its members, and its agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising from your use of the Site or content, even if advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim or $50, whichever is less.
7. Indemnification
You agree to defend, indemnify, and hold harmless The Stove is On and its members from any claims, damages, liabilities, and expenses (including attorneys' fees) arising from your use of the Site, your violation of these Terms, or your infringement of any intellectual property rights.
8. Governing Law & Dispute Resolution
These Terms shall be governed by the laws of the Provence of Ontario, without regard to its conflict of law principles. Any legal action shall be brought exclusively in the provincial or federal courts located in Toronto, Ontario. You agree to submit to the personal jurisdiction of these courts.
9. Digital Millennium Copyright Act (DMCA)

10. Miscellaneous
These Terms constitute the entire agreement between you and The Stove is On. Our failure to enforce any right is not a waiver of that right. If any provision is found invalid, the remaining provisions will remain in effect.
